Regulation of Labour Relations Status, Protection and Competence of the Film Industry

It is well known that the demands on the professionalism of actresses and actors in the film industry are enormous. The reality is that film workers are still not properly positioned as professionals. The film industry needs significant improvement so that actors, as an integral part of film production, can get adequate safety, health and welfare protection according to professionalism. Therefore, the status of employment relationships, protection and recognition of the competence of actors needs to be well regulated through a regulation with the Ministry of Education and Culture, Ministry of Labour, Associations, and stakeholders to ensure the legality of recognition of employment relationship status, safety protection, occupational health, welfare and actor competence.

Seeing the importance of these regulations, Chairman of the Professional Certification Standing Committee of Kadin Indonesia, Hari Wijaya became a guest speaker in a talk show on professional recognition and protection of Indonesian film artists' rights, with the theme "Protection & Competency Standardisation for Actors in Indonesia" (27/11/2023). The talk show was chaired by Marcella Zalianty as the elected Chairperson of the Indonesian Film Artist Association 1956 (PARFI'56).

In order to achieve the Government's vision of creating "Advanced Indonesian Superior Human Resources", support is needed to develop competent human resources (HR). Certification is considered as a means to ensure that these human resources have skills and abilities that can adapt to technological developments in accordance with the needs of stakeholders and organisations (appropriate relationships and linkages).

According to Law No.13 of 2003 Article 18, it is explained that certification is the right of all workers. Where workers are entitled to obtain recognition of work competence after attending job training organised by government job training institutions, private job training institutions, or training in the workplace. And recognition of work competence is done through certification of work competence.

In the Talkshow activity there were 2 sessions, in the first session guided by Moderator Ajeng Sharfina Adiwidya with speakers: Minola Sebayang (Lawyer), Aghniny Haque (Actress), Ayu Dyah Pasha (Actress), Rommy Fibri Hardiyanto (Chairman of LSF), Jenny Jamora (League of Phillipines Actors), Dede Yusuf (Representative of DPR Commission X) and for the second session guided by Moderator Maudy Koesnaedi with speakers: Ine Febriyanti, Putri Ayudya, Naswan Iskandar, Hari Wijaya and Calvin Moniaga (ACI) with the following discussion results:

  1. It is necessary to clarify the legality of the artist's employment status from the Ministry of Manpower.
  2. FGD with Kadin Vocational and Certification Bid, Kadin Film Bid, Directorate of Competency Standards and Training of the Ministry of Manpower RI, Directorate of Manpower Development and Cultural Institutions of the Ministry of Education and Culture RI and Parfi following up on related talk shows:
  • Kempmen 346 of 2019 Determination of the Indonesian National Standard of Competence in the Field of Arts, Entertainment, Recreation, Principal Group of Activities of Entertainment, Arts, and Creativity in the Field of Film Casting
  • Labour Relations Status of Workers and Social Security Protection
  • Indonesian artist certification

 

In accordance with Kadin's role in Competency Standardisation and Professional Certification, which is regulated in Presidential Regulation 68 of 2022 concerning Revitalisation of Vocational Education and Vocational Training, Ministerial Decree 166 of 2020 concerning the Competency Standard Committee for Manpower is:

  1. Indonesian National Competency Standards as referred to in paragraph (2) letter a are prepared by KADIN, business associations, and professional / industrial associations in coordination with ministries / institutions in accordance with their respective sectors.
  2. Functions of the members of the Competency Standard Committee for Employment: carry out tasks and report on the results of the task of preparing, determining, and reviewing SKKNI and KKNi in the field of employment.

 

The hope is that Kadin, PARFI '56 and film entities with this kind of activity can understand and know the protection for professional actors and recognition of their competence recognised by the state through the BNSP Professional Certification Institute and this activity will be followed up with joint FGDs to formulate certainty of employment relationships, protection and recognition of certification for film people.
